Article 4: DELIVERY

4.1 Delivery Terms

Delivery occurs upon handover of the products to the buyer. Delivery is made to the address provided by the buyer at the time of the order. The delivery slip must, where applicable, be signed by the buyer, who must check upon receipt the conformity and condition of the product’s packaging. Any damaged product must be refused, and any reservation must be immediately recorded on the delivery note and communicated to the carrier and to MOOV360 SRL by registered letter with acknowledgment of receipt within three (3) calendar days. If the buyer is a consumer, personally takes delivery of the transported items, and the carrier cannot demonstrate that the buyer was given the opportunity to verify their proper condition, this period is extended to ten (10) calendar days.

4.2 Transport

MOOV360 SRL is responsible for organizing the transport. Delivery costs are borne by the buyer. However, for deliveries within Belgium for any order equal to or exceeding one hundred fifty (150) euros, MOOV360 SRL will cover the delivery costs.

4.3 Transfer of Risk

The risk is transferred to the buyer upon handover of the products. Until that moment, the products travel at the risk of MOOV360 SRL.

4.4 Delay or Failure of Delivery

The standard delivery timeframe is thirty (30) calendar days unless otherwise specified. The buyer is informed that these delivery times may be extended, notably in case of stock shortages or for new products still in production. Any delay cannot give rise to compensation, retention, or automatic cancellation of pending orders. In the event of a delay, the consumer may formally request, in writing or by any durable medium, that MOOV360 SRL complete the delivery within a reasonable additional period. If delivery is not completed within this additional period, the consumer may, using the same means, request the termination of the sale, which will take effect upon receipt of the request by MOOV360 SRL. The buyer will then be refunded all amounts paid, no later than fourteen (14) days following the date on which the contract was terminated. Under no circumstances shall non-delivery engage the liability of MOOV360 SRL if the delivery is impossible due to an error or omission on the part of the buyer when entering the delivery details.
